Article 1 - Purpose

These terms and conditions govern the sales by the ASBL Les Clinicoeurs de la Salm of well-being products, embroidery, and other items.

Article 2 - Price

Our prices are in euros, including all taxes, unless otherwise stated. For international orders, you are responsible for customs duties and local taxes. All orders must be paid in euros. Our prices may be subject to change, but the price charged will be the one in effect at the time of order validation, subject to availability. Products remain our property until full payment is received. For returned products, any costs incurred due to loss or damage are your responsibility. “Gift” checks are valid for one year.

Article 3 - Orders

The contractual information is presented in the French language and will be confirmed at the latest when your order is validated. ASBL Les Clinicoeurs de la Salm reserves the right not to record a payment and not to confirm an order for any reason, particularly in cases of supply issues or difficulties with the received order.

Article 4 - Validation of Your Order

By placing an order on our website, you accept our General Conditions. An order confirmation implies your full acceptance of these general sales conditions, without exception or reservation. All information provided and the recorded confirmation will be considered as evidence of the transaction. You declare that you have perfect knowledge of these conditions. The order confirmation will be considered as a signature and acceptance of the operations carried out. A summary of your order will be sent to you by email to the confirmation address.

Article 5 - Payment

Confirming your order implies an obligation on your part to pay the indicated price. Payment for your purchases can be made by credit card through the secure system or by bank transfer or in cash.

Article 6 - Withdrawal

You have 14 days from the receipt of your products to exercise your right of withdrawal. During this period, you can return the products without having to provide reasons or pay penalties. Returns must be made in their original condition, with complete packaging, accessories, and instructions. You are responsible for any damage caused to the product during the return, which could void your right of withdrawal. The return costs are at your expense. If you exercise your right of withdrawal, we will refund you within 14 days following the notification of your request, using the same payment method as used during the order. Please note that there are certain exceptions to the right of withdrawal.

Article 7 - Availability

Our products are offered as long as they are visible on the website and within the limits of available stock. For products that are not in stock, our offers are valid subject to availability from our suppliers.

Article 8 - Delivery

Products are delivered to the delivery address provided during the ordering process, within the timeframe indicated on the order validation page. In case of a shipment delay, you will receive an email notification. Our deliveries are carried out by the Belgian post, Mondial Relay, and other applicable postal or delivery services.

Article 9 - Warranty

All our products are covered by the legal warranty of conformity and the warranty against hidden defects. In the event of non-conformity of a product, you have the option to return it, exchange it, or receive a refund. All claims, exchange or refund requests must be made by email within 14 days after delivery. The products must be returned in their original condition, with all components (accessories, packaging, instructions, etc.). These provisions do not affect your right of withdrawal as provided in Article 6.

Article 10 - Liability

The products we offer comply with the current legislation in Belgium. The company disclaims any responsibility in case of non-compliance with the legislation of the delivery country. It is your responsibility to inquire with local authorities about the possibilities of importing or using the products or services you wish to order. Furthermore, the company is not liable for damages resulting from the improper use of purchased products. Finally, the company cannot be held responsible for inconveniences or damages related to the use of the Internet, such as service interruptions, external intrusions, or the presence of computer viruses.

Article 11 - Applicable Law in Case of Disputes

The language used in this contract is French. The terms of sale are governed by Belgian law. In case of a dispute, only Belgian courts will have jurisdiction.

Article 12 - Intellectual Property

All elements of the website are and remain the intellectual and exclusive property of the company. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the website, whether they are software, visual, or auditory. Any simple or hypertext link is strictly prohibited without express written consent from the company.

Article 13 - Personal Data

We collect your personal information and data, which is necessary to manage your order and improve our services and information. This information may be shared with companies involved in the management, execution, processing, and payment of services and orders. It is also retained for security purposes and to comply with legal and regulatory obligations. You have the right to access your personal information and data, rectify it, and object to its use directly on our website.

Article 14 - Archivage Preuve

The company will archive the purchase orders and invoices on a reliable and durable medium, constituting a faithful copy.
